Terms of service

Pixelette is a brand operated by Shasan Industrial Tech, Girgaon, Mumbai, Maharashtra 400004, India (GSTIN: 27GUIPS5375A1ZA). In these Terms, "we", "us" and "our" mean Shasan Industrial Tech, and "you" means the customer.
These Terms, together with our Privacy Policy, Shipping Policy and Return & Refund Policy, govern your use of pixelette.shop, create.pixelette.shop, and any related services (the "Services"). Our store is hosted by Shopify.
By using the Services, you agree to these Terms. If you do not agree, please do not use them.
1. Eligibility and your account
You must be at least 18 years old to place an order. If you allow a minor in your care to use the Services on a device you control, you are responsible for their use.
You are responsible for keeping your account credentials secure and for activity on your account. You may not transfer or sell your account.
You confirm that the information you give us name, address, contact and payment details is accurate and that you are entitled to provide it.
2. Our products
Our kits are made-to-order craft products. Colours and finished appearance may differ from images on your screen depending on your device and its settings, and the finished piece depends on the photograph you supply. We describe our products as accurately as we can, but we cannot guarantee that the result will match your expectations in every respect.
Diamond kits contain small parts and are intended for older children and adults.
We may change product descriptions, discontinue products, or limit order quantities at any time.
3. Orders and pre-orders
When you place an order you are making an offer to purchase. Your order is accepted when we send you an order confirmation. We may decline an order, and if we do we will notify you using the contact details you supplied and refund any payment in full.
Pre-orders. Kits sold on pre-order are not in stock when you buy them and will be dispatched on or after the date shown on the product page. If that date changes, we will email you before the original date passes and you may cancel for a full refund.
Cancellation. You may cancel any order, including a pre-order, for a full refund at any time before it is dispatched. Email hello@pixelette.shop with your order number. After dispatch, our Return & Refund Policy applies.
You buy for your own personal or household use, not for resale.
4. Prices and payment
All prices are in Indian Rupees and are inclusive of GST. Shipping is free within India. The amount shown at checkout is the total amount payable, with no additional charges, except a redelivery fee where a parcel is returned to us because of an incorrect address, as set out in our Shipping Policy.
The price that applies is the price shown when you place your order. We may change prices, run promotions, or correct pricing errors at any time. Where a promotion has its own terms, those terms apply.
Payments are processed by Shopify Payments and other payment providers. You confirm that you are authorised to use the payment method you provide.
5. Shipping and delivery
We ship within India only. We do not currently ship internationally.
Delivery times shown in our Shipping Policy are estimates from our courier partners and are not guaranteed. We are not liable for delays caused by couriers, weather, strikes or other events outside our control.
Risk in the goods passes to you on delivery. If your parcel is confirmed lost in transit, or arrives damaged or incomplete, we will replace it or refund you in accordance with our Shipping Policy and Return & Refund Policy.
6. Your photographs and the activation code
Each kit includes a one-time activation code that unlocks pattern generation at create.pixelette.shop. Codes are single-use and tied to one kit.
You keep all rights in the photographs you upload. You grant us a limited licence to use your photograph solely to generate your pattern, produce previews you request, and provide you with support. That licence ends when we delete the photograph under our Privacy Policy.
We will not publish, display or use your photograph, preview or pattern for marketing without your separate written permission. Section 11 does not apply to photographs you upload or send us.
You confirm that you have the right to use each photograph you upload, and permission from anyone identifiable in it, or from their parent or guardian if they are a child. You must not upload unlawful, obscene, or infringing images. We may refuse to process an image on these grounds and will refund you if we do.
The instruction PDF we generate is licensed to you for personal, non-commercial use.
7. Intellectual property
The Services and their content — our brand, logo, text, images, designs and layout — are owned by us or our licensors and are protected under Indian intellectual property law.
You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, modify, republish or distribute our content without written permission. "Pixelette" and our logo are our trademarks. Shopify's marks belong to Shopify.
8. Reviews and other submissions
If you post a review, comment, suggestion or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce and display it in connection with the Services and our marketing.
You confirm that the content is yours to submit, that you have disclosed any incentive you received for it, and that it is not unlawful, defamatory or infringing. We may remove content at our discretion. We are not obliged to keep submissions confidential or to pay for them.
This section does not apply to photographs you upload for pattern generation or send us for a preview — those are governed by section 6.
9. Acceptable use
You may use the Services only for lawful purposes. You must not:
- break any applicable Indian law or regulation
- infringe our intellectual property or anyone else's
- harass, abuse, threaten or defame any person, including our team
- transmit false or misleading information, spam, or malware
- impersonate another person or entity
- scrape, harvest, or use bots or automated tools to access the Services
- attempt to bypass our security measures
- collect other users' personal information
We may suspend or terminate access if you breach these Terms.
10. Third-party services and links
Our Services rely on and link to services we do not control, including Shopify, Shiprocket, Render, WhatsApp, Instagram and YouTube. We are not responsible for their content, availability or practices, and your use of them is at your own risk under their own terms.
Any sales you make are directly with Pixelette, not Shopify. Shopify is not responsible for any aspect of a sale between you and us, including any injury, damage or loss arising from products purchased.
11. Errors
Information on the Services may occasionally contain errors relating to descriptions, pricing, availability or delivery times. We may correct errors, update information, or cancel an affected order at any time, including after you have placed it. If we cancel, we will refund you in full.
12. Disclaimers and liability
Except as expressly stated in these Terms and our policies, the Services are provided on an "as is" and "as available" basis. We do not warrant that the Services will be uninterrupted or error-free.
To the extent permitted by law, we are not liable for indirect or consequential losses, including lost profits, lost data or replacement costs. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
Nothing in these Terms limits or excludes your rights under the Consumer Protection Act, 2019, or any other Indian law that cannot be excluded by agreement. Where any provision conflicts with those rights, your statutory rights prevail.
13. Indemnity
You agree to indemnify us against third-party claims, losses and reasonable legal costs arising from your breach of these Terms, your violation of any law or third-party right, or your uploading of a photograph you did not have the right to use.
14. Termination
We may suspend or end your access to the Services if you breach these Terms. You remain liable for amounts due up to that point.
Sections 6, 7, 8, 12, 13 and 15, and any other provisions that by their nature should survive, continue to apply after termination.
15. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at Mumbai, Maharashtra have exclusive jurisdiction over any dispute, subject to your rights to approach a consumer forum under the Consumer Protection Act, 2019.
16. General
If any provision of these Terms is found unenforceable, the rest continues to apply. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies referred to above, are the entire agreement between us. You may not assign your rights under these Terms; we may assign ours.
We may update these Terms by posting a revised version on this page and updating the date at the top. Material changes take effect from the date stated in the notice.

In line with the Consumer Protection (E-Commerce) Rules, 2020, we will acknowledge any complaint within 48 hours and aim to resolve it within one month of receipt.
